Eligibility to Use

Use of the Platform is available only to individuals who are at least eighteen (18) years of age and legally capable of entering into binding agreements under applicable Indian laws. Users suspended, restricted, or removed by Ottodeals for any reason shall not be permitted to access or use the Platform.

Ottodeals reserves the right to refuse access to any User or terminate existing access at any time without assigning reasons.

Registration of Account

Users may access certain parts of the Platform as visitors; however, registration may be required to access listing, dealer lead purchase, or account-based services.

Users may be required to register using mobile OTP verification, dealer credentials, passwords, or other authentication methods introduced by Ottodeals from time to time.

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. You agree to immediately notify Ottodeals if you suspect unauthorized access or misuse of your account.

Users shall provide accurate, current, lawful, and complete information. Ottodeals reserves the right to suspend, edit, remove, restrict, or terminate accounts containing misleading, incomplete, suspicious, unlawful, or fraudulent information.

User Representations and Obligations

You agree to use the Platform only for lawful purposes and in accordance with these Terms and applicable laws.

You agree not to misuse the Platform, including but not limited to fraud, impersonation, harassment, posting misleading information, uploading fake vehicle listings, abusing users, scraping data, unauthorized copying, hacking, spam activity, unlawful conduct, misuse of seller or dealer information, or any activity harmful to Ottodeals or its users.

You shall not attempt to gain unauthorized access to any part of the Platform, servers, systems, or networks connected to Ottodeals through hacking, automated tools, bots, scraping software, or any illegitimate means.

Ottodeals reserves the right to investigate suspicious conduct and may suspend, terminate, block, or permanently disable any User account without prior notice.

Seller Listings

Vehicle sellers may publish vehicle listings on Ottodeals by paying an applicable listing fee, currently ₹99 or such revised amount as determined by Ottodeals from time to time.

Payment of a listing fee does not guarantee listing approval, lead generation, dealer interest, successful sale, or deal completion.

Sellers represent and warrant that all vehicle information provided on the Platform, including photographs, ownership details, pricing, condition, loan status, insurance, accident history, taxation, odometer reading, and supporting information are accurate and lawful.

Ottodeals reserves the right to reject, edit, suspend, review, remove, or refuse any listing which appears false, misleading, duplicate, suspicious, incomplete, unlawful, offensive, or inconsistent with Platform standards.

Dealer Lead Purchase

Dealers may access seller contact information through paid lead unlocking services offered by Ottodeals.

Dealers may be required to pay a lead access fee, currently for example ₹499 or any revised amount as may be determined by Ottodeals from time to time.

Lead access payment grants limited access to seller contact information only and shall not constitute or be interpreted as any guarantee of seller response, seller availability, vehicle availability, successful purchase, deal closure, vehicle quality, legal ownership, pricing accuracy, or transaction success.

Dealers acknowledge that vehicle purchase decisions are solely their responsibility and independent verification and due diligence must be carried out before entering into any transaction.

Payments & Pricing

All payments on Ottodeals may be processed through third-party payment gateway providers, including PhonePe Payment Gateway or any other provider introduced, modified, replaced, or discontinued by Ottodeals at its sole discretion.

Ottodeals reserves the unrestricted right to modify platform pricing, fees, payment structures, features, lead charges, listing charges, subscriptions, promotional offers, and service models at any time without prior notice.

Payments, cancellations, disputes, and refunds shall be governed by the Ottodeals Cancellation & Refund Policy, as updated from time to time. By using the Platform or making payments, Users agree to be bound by the applicable Refund Policy.

Intellectual Property

All trademarks, logos, software, text, graphics, layouts, designs, features, interfaces, branding, and content available on the Platform belong to Ottodeals or its licensors and are protected under applicable intellectual property laws.

Users shall not copy, reproduce, distribute, reverse engineer, modify, commercially exploit, or otherwise use Platform content without prior written authorization.

Nature of Platform

Ottodeals operates solely as a digital lead-generation and listing marketplace connecting vehicle sellers with automobile dealers.

Ottodeals does not buy, sell, inspect, certify, guarantee, broker, finance, own, evaluate, possess, negotiate, or facilitate transfer of ownership of any vehicle listed on the Platform.

Ottodeals is not a party to any final vehicle transaction between sellers and dealers.

Seller Contact Sharing

By listing a vehicle on Ottodeals, sellers expressly consent that their contact information may be shared with registered dealers after successful payment and lead purchase.

Seller information is shared solely for communication regarding vehicle purchase opportunities.

No Guarantee by Ottodeals

Ottodeals does not guarantee seller response, dealer response, vehicle quality, vehicle availability, ownership authenticity, document accuracy, accident history, service history, deal closure, payment safety, inspection outcomes, pricing accuracy, or transaction completion.

Users acknowledge that all vehicle transactions are conducted entirely at their own risk.

Due Diligence Responsibility

Dealers and sellers are solely responsible for independently verifying vehicle ownership, documentation, legal title, insurance, RC status, accident history, pending challans, taxes, loan obligations, and any other legal or commercial matters before proceeding with a transaction.

Ottodeals shall not be liable for fraud, false information, financial losses, title disputes, ownership disputes, failed transactions, misleading claims, or vehicle-related disputes between users.

Disclaimer of Warranties & Limitation of Liability

THE PLATFORM AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

OTTODEALS DOES NOT WARRANT THAT THE PLATFORM WILL OPERATE WITHOUT INTERRUPTION, ERROR, TECHNICAL FAILURE, DELAY, DATA LOSS, OR SECURITY BREACHES.

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, OTTODEALS, ITS OWNERS, AFFILIATES, EMPLOYEES, AGENTS, REPRESENTATIVES, TECHNOLOGY PROVIDERS, AND PARTNERS SHALL NOT BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, COMMERCIAL, FINANCIAL, REPUTATIONAL, OR SPECIAL DAMAGES ARISING FROM PLATFORM USAGE, USER CONDUCT, VEHICLE DISPUTES, FAILED TRANSACTIONS, MISINFORMATION, PAYMENT ISSUES, OR LEAD PURCHASES.

Violation of Terms

Ottodeals may, in its sole discretion and without prior notice, suspend, terminate, block, or restrict User access if these Terms are violated or if suspicious, fraudulent, abusive, unlawful, or harmful conduct is detected.

Users agree that violations may cause irreparable harm to Ottodeals and Ottodeals shall be entitled to legal and equitable remedies available under law.

Indemnification

You agree to indemnify, defend, and hold harmless Ottodeals Network, its owners, employees, affiliates, agents, representatives, and partners against claims, losses, liabilities, damages, legal proceedings, costs, or expenses arising out of your misuse of the Platform, violation of these Terms, unlawful activity, disputes, fraud, or misleading information.

Communications

By using Ottodeals, you expressly consent to receiving communications through SMS, WhatsApp, calls, notifications, and email regarding OTP verification, listings, lead purchases, customer support, account activity, marketing communications, updates, and service announcements.

Users may request to opt out of promotional communications, though transactional communications may continue where necessary.

Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. Any dispute arising out of or in relation to these Terms or Platform usage shall be subject to the exclusive jurisdiction of courts located in Pune, Maharashtra, India.
